MS 'aware' of Modern Warfare 2 leaks
Microsoft has told a UK publication that is aware of the Modern Warfare 2 leaks following news that it had been leaked up to 10 days before its schheduled release date. They specifically told MCV: “We are aware of the reports but cannot comment on ongoing investigations.”

Nobody will EVER stop games from being leaked unless they are strictly sent to retailers 1 day before the actual release date.

It's an interesting point Strebor_. When I used to work in a computer shop ('89 to '95) even when it was 'Sonic 2'sday' we never got the stock days in advance - it was ON the Tuesday it was released. I suppose today's logistics just do not make it possible for them to do that anymore.
I will also say though it isn't just this which is the problem - I remember Amiga games were cracked WAY before release dates and that couldn't of been down to dodgy retailers, I think most of that was dodgy people at duplication plants.
Didn't the original leaked CoD:MW2 come from one of the new XBOX 360 packs which was sat in a toys 'r us warehouse? - others have come after this one though.
To stop it - I think Ban-Hammers are the way to go - I think it will make people think twice about playing, but ban the console and gamertag.

They can't ban you for for playing a game early, if they did then there would be serious issues.
Many retail outlets have the game already, it's there fault if they break the street date, not the end user.
But yeah i agree the old Atari St/Amiga games i used to get well in advance of any retail date.

who gives a flying **** if a game is played 10 days "early".
"early" compared to what? an arbitrarily set date by some marketing department.
nothing to investigate here, move along.

Technically, they can if they suspect that you are playing a burned copy. During the ODST fiasco, Microsoft stated that if they banned you by mistake, you have to send them proof of purchase.

If it is played early, it is pirated (Most likely). THAT leads to investigations.

here is where Digital Distribution will come into play within the next 5-10 years. You only get the game when they want you to get it, or you can "rent" it online and download it and after x amount of days it will auto delete itself.
