No Doubt sue Activison over use of 'Band Hero' avatars

No Doubt has filed a law suit against Activision claiming a breach of contract as their likenesses could be used to sing songs by other artists. Apparently this has turned the band into a virtual karaoke circus act, or at least that is what they are claiming.

Now No Doubt have made a similar discovery about their own avatars in Band Hero — and they’re taking swift legal action. The band filed a lawsuit against the game’s maker, Activision, today, for fraudulent inducement and breach of contract, among other complaints, in which they argue the group was turned into “a virtual karaoke circus act.”

The band’s manager, Jim Guerinot, tells Rolling Stone No Doubt were “mortified” to discover their likenesses could be used to sing songs by other artists. “They’re just like, ‘What? We didn’t sign up for this,’ ” he says.

At least they are still alive to fight it, poor Jimi and Kurt had to sing other peoples songs that hadnt even been written yet before they died. I personally find the use of dead rock stars images as a bit disturbing...maybe if some living artists take action Activision can see just how messed up this really is. I can see digital avatars singing songs of the artists they originally sang in fact its kind of a neat tribute (ala rockband beatles) but having Kurt Cobain singing Weezer and Elton John is just plain wrong.

Still No Doubt signed the contract...they should have paid attention to what they were getting into. You would think that Activision would be smart enough to use the "guest artists" as a bonus when those artists songs are played...that would make it more "special" anyway. Still I cant help but think of the amusement Im going to have upsetting my daughter (who wants Band Hero badly) when I have Taylor Swift singing stuff like Ace of Spades...now if only I they had NIN Closer...

lol looks like they didn't read the fine print. It will either be settled out of court, or Activision will have the balls and win.

Activision statement:

Some of the world’s most popular and iconic artists have been featured in Guitar Hero as playable characters, and we are proud to count No Doubt among them. Activision has a written agreement to use No Doubt in Band Hero — an agreement signed by No Doubt after extensive negotiations with its representatives, who collectively have decades of experience in the entertainment industry. Pursuant to that agreement, Activision worked with No Doubt and the band’s management in developing Band Hero. As a result, Activision believes it is within its legal rights with respect to the use and portrayal of the band members in the game and that this lawsuit is without merit. Activision is exploring its own legal options with respect to No Doubt’s obligations under the agreement.

Why? because he think its just as sad as many of us other to use a dead person to make money?
I grew up with nirvana, nd if I saw Kurt singing The sweeter song or Buddy holly I would cry... And not ina good way.

Activision worded the contracts to where stuff like this wasnt noticed.
If you go through all these, you will see that each band thought it was going to be used for its own songs, not random sngs that were out befoe they were even a band... or fter they died

Ummmm you obviously misunderstood who I was suggesting we apply the "Death Penalty" to, but here's a hint... it wasn't at grapeape.
