View Full Version : Is The Wiikey and backing up games you own Legal???

Ok i have a interesting story to tell so please, i beg, read on...It's a goodun!

I went into a shop to purchase some DVD-R discs to back up some games for my nephews Wii. The shop was a small independant shop dealing with PC and Consoles, very very messy shop but quite nice nonetheless.

I was happily browsing away and i asked the owner if he stocked Taiyo Yuden DVD-R's and he proceeded to inform me that there were no such discs as Taiyo Yuden make Dyes for other disc manufacturers only. He then said he stocked white tops made by Ritek. "Great" i thought!

He asked why i was looking for Taiyo's,
Foolishly (thinking he was an ok guy) i said that i was backing up some games for my nephews Wii as he tends to scratch the discs alot.

He replied so you have a mod chip fitted and i said "yes". With that he then said "thats illegal and i am sorry but i will not serve you"

Shocked at this i then said "but my nephew owns the originals" and he said it doesn't matter if the console is breached in any way whatsoever and the game code is copied or the firmware is altered its illegal.

He had the last word because it was "i am not going to serve you please leave".

i was absolutely STUNNED!! why is he so concerned with what i do with the discs?? was he right to refuse me service or the opportunity to purchase from his shop on the grounds that he didn't like what i planned to use the disc's for??? please guys and girls i really want your feedback on this one!

So i want to also ask is it illegal to modify a console to play backed up games?? Does anyone out there know officially if it is or isn't? If anyone could come up with an official publication or quote from somewhere please add it in this post. I really hop it is legal because i want to take something official to him and stick it under his pompus hairy face. (sorry getting a bit angry)

Laws differ, though most interpretations suggest making a single backup of the media is allowable. Telling the guy in the shop you had a modded console and wanted to 'backup' your games was not a smart move - he makes money from selling the stuff so he isn't going to be sympathetic is he? He is not obliged to serve you and you are not obliged to buy anything from him, so I'd leave it at that.

Eh that's kind of dumb... it's not like you're gonna get charged for providing you the discs. What you do with it would be for private use.

Thank you for that! i guess that does make sense! But he lost out on me spending my money in his store

Off the record....He was selling wii and two games for wait for it....£600!! and wii games alone....£49.99!

wow, sounds like a real jerk but what are you gonna do eh? You really have to be careful who you mention it to these days because piracy and "backups" are much more infamous this generation than they were last. I was just browsing through divineo looking for a D2Ckey and found out the bad news. They'll be other places to buy discs. he loses in the end not you.
