View Full Version : Plantiffs seeking to sue MS for over $5 million dollars over scratched discs

A Florida based plantiff and his layers are seeking more than five million dollars from MS to cover damages and costs following the Xbox 360 scratching discs. The lawsuit perpetuates that the plantiffs in the case have been damaged due to their discs being destroyed via normal and intented use. They attack MS for the negligent design of the Xbox 360 as the console's laser discs reading assembly contacts and scratches the disc during intended use. Further to this, they back up their claim with the study conducted by a Dutch TV program Kassa and that it was not possible to play Madden NFL 07 as a result of the disc scratching.

when you say layers are they going to s**g them to get the money?

if everybody did the same then our £200 console would be worth £2,500,000.yes!go out and buy your £200 console today tomorrow it'll be worth £2,500,000.

come on ffs's how the frig is a 360 worth $5,000,000?

oh wow. suing MS just because their 360 lens scratch their games? they could have used the warranty that it came with. that is if it even came with one.

Idiot. MS will pull out a 360 in court. Move it while running. Show the manual says its not a portable device and shouldn't be moved while in operation and offer the people a replacement disc for a fee. They will never see a $.

I don't see just as there can be the 360 price cut. I believe that Microsoft is having a lot of losses of budget because of the warranty.

It won't work that easily. The Plaintiff could easily bring a 360 of his own that is tweaked to scratch, just like Microsoft will bring in one that will not scratch.

Actually, yes, if this is a class-action law suit. I'm not sure this is though.

This problem happens on the TS drives more than the Hitachi.

You can tell if you have a machine which will put lines on your disc,
if when inserting a game or ejecting a disc, you hear a weird screech
sound and then the normal disc spining sound, or the reverse going
from a normal disc spinning sound to a weird screech sound just before
the tray ejects.

It happens very often with wear and tear on the MS28 drives more
than any other model, and it is due to weaking of the grip of the
plastic hub center on the top of the cover with the main motor hub.

Over time with the heat of the x360, the gap betwen the plastic hub
and the motor increases to a point were the disc normally is firmly
clamped tight between the motor and top spindle hub, as a result
the disc spins off balance or wobbles a bit during the spin-up and
spin-down of the motor during first insert and later eject of the disc,
causing parts of the disc to rub onto the plastic tray, leaving small
bits of round circles marks, or worse case complete round scratch.

The bottom can be easy fixed, but gently bending down the top
cover a bit to a point were the weird screech sound is no longer
hear when ejecting a spining disc.

This same problem happen on the first Thompson XBOX1 drives.
