Oopsy - MS banning non modded Xbox 360's from Live too!

Despite a huge backlash from modders, it seems as if Microsoft are going to have to contend with another angry party - owners of non modified console are who finding themselves banned from Live as a result of the new policy. Large numbers of Xbox 360 gamers are stating that they have been banned from Live recently despite owning a perfectly original Xbox 360 console, you can view evidence of this at <a href="http://forums.xbox.com/2/12538432/ShowPost.aspx#12538432" target="_blank">Xbox.com</a>.

It's too be expected you're going to receive reports from people saying they were legit when they infact weren't. People that commit crimes don't always plead guilty in court either ;). And also I can guarantee that refurbished units by Microsoft go through a standardized procedure once "fixed" to restore the console back to it's default.

more and more it is getting a little bit embarrasing for microsoft as well as for sony.

on the microsoft side we have the rings of death, scratched DVDs, 3rd party software bricking consoles, the elite-instead-of-price-drop fiasco and now the texas ban massacre. fortunately my used 360 works fine and as i am a big enemy of micropayment and have no interest in downloading half-as* demos or trailers or online gaming i am fine personally, but thought globally it is getting worse and worse.

i bought my console for gaming without any interest in the online part and i will be one happy bloke once it is finally possible to run homebrew software on the 360 and will be the first with a mod chip when that finally happens.

some people made a pretty good point around here: people that are banned won't spend their money on senseless s*hit in the marketplace. as this is a major money bringer for microsoft that step is just plain dumb. who pays the unreasonable high prices for a downloadable guitar hero 1 if he can not get onto the marketplace?

anyway, for my taste microsoft tries a little too hard in keeping people from playing backups. one of the big selling points of the PSOne and the PSTwo were the availability of loads of games and the possibillity of copying them.
it does absolutely nothing to the software sales, no matter what companies say, but it gives the hardware sales a definite boost.

and to make the bots happy, here is the counterpart:
sony would do better to release the ps3 20gb worldwide and spend it a price drop instead of stopping it's production on that one. a ps3 20 gb costs around $350 in japan. make it a $300 available everywhere you can count me in. oh, and some games wouldn't hurt either.

This happends in anything from pc gaming to console gaming people that get banned will always try to defend themselves and claim they were playing legit. Of course there could very well be a small population of people being unrightfully banned but the mass majority of the people claiming that they were legit and claiming they know nothing about modding are the ones that are cursing microsoft under their breath. I doubt Microsoft and the team overlooked the fact of refurbished consoles or any other variable in the bannings this was planned and tested for a while. Most if not all, are claiming to have been banned when playing the halo 3 beta, downloading the halo 3 beta, or playing crackdown. The ban most likely picked up on a special id or key that crackdown displayed and banned everybody sharing that same id. A majority of the modders were playing off the same downloadable Crackdown game dump all sharing the same id/key(of course there was probaly multiple id/key's that were banned do to multiple public crackdown dumps).

Yep, same here. I honestly bought the 360 because of the hackability of the Xbox, that and Gears of War. Online really doesn't apply to me because both the PSN and Xbox Live are filled with 13 year olds saying mindless phrases like "I PWNED YOUR ASS!" or even the 19 year olds who lack in a vocabulary spouting nonsense like "SUCK MY **** YOU **** SUCKING ***!". The latter being people that play Gears of War 24/7. I...try and stear away from people who like to talk smack rather then play the game.

Im personally done with microsoft but for some of you out there that have been banned you can still get online for like 150 bucks if you go out and buy another motherboard but you have to make sure you have a dvd key with the board

I just got home to see if I was banned and all I can say is Halo3 is maaaaad fun. I hope I can still sign onto Xbox Live tomorrow. If not, oh well. I was planning on buying an Elite anyways with no intention of modding it. I have a Samsung drive, and an original copy of Crackdown since I bought it day 1 and didnt mod my 360 till about 2 months ago. lol What are you talking about "scan drives"? I never said microsoft scanned drives. What I said was that when receiving a refurbished console you can guarantee that it will be flashed with the most current firmware and or software at the time of being shipped and set to factory defaults (this includes almost any form of electronic that has upgradable firmware "psp" for example) . Why did I say guarantee? Because its factory standards when refurbing these kind of electronics. We have already gotten into a discussion on another thread about refurbished electronics where you were proven wrong not just by me but other posters. You can believe whatever you choose to believe and if you're naive and uneducated about these topics there really isn't much use of fighting because you will only believe what you think is correct.

There is no doubt that Microsoft can infact "scan" the drives or pick up on what firmware the dvd drive is currently using. It's evident in the recent bannings that this is indeed the case but is not what I was referring to. I was explaining the standardized process that the refurbish units go through at the factorys when getting "worked on". The workers will not treat each unit sent in as a seperate case and try to determine which modded firmware the console had on it and try to come up with a solution. They have a set of practices that they will go through that are applyed to every unit where each 360 will be plugged in and determined which are the correct firmware and newest software to be applyed and then flashed accorandly.

Microsoft has stated now that this has been a on-going event and some people have been detected for quite a while. Why they started to banning everybody now, who knows? But everybody using the same modified firmware shared the same firmware indetification key so most people claiming to have legit systems either are obviously lying or have modded in the past. The banning software was ment to go after certain indetifications on these modded firmwares leaving a almost impossible (if any) space for error of detection against legit dvd firmware. But to put it simply because all the modders share the same modded firmware they all have the same identity. The identity's for each of these modded firmware from the most current to some of the previous versions have now been blacklisted. The people that mod their consoles know the risks and it's silly to think that Microsoft or any other company owes something to you for pirating their software or games.

Even if they don't scan your drives (windows update anyone? if it isn't scanning, how does it know what is on your PC and why does it take so long to find out?), it sounds completely illegal to ban people from a pre-paid for service, especially if they follow reasonable ToS agreements - regardless of the state of the hardware they have at home. I mean, I could understand these types of bans if Live were free... but it's NOT.

Imagine getting banned from Steam, or whatever that monstrosity is called, simply because you change out your dvd drive - essentially denying you access to services you already paid for, in advance.

Yet another reason I will not support M$, I guess all that is left for me is to hope the PS3 gets some decent games before I can afford it and boycott any future purchases from M$. Looking back, I am very thankful I got my xbox1 used, broken, cheap, and pretty much requiring a modchip to fix the ring of death.

The people that mod their consoles know the risks and it's silly to think that Microsoft or any other company owes something to you for pirating their software or games.
Are they at least giving substantial refunds for prematurely canceled live accounts? That, in my mind, is the only way they could justify these types of bans to me.

BTW: have they started offering a reasonable quantity of replacement disks for when the drive unit screws them up? Because backups and a method to use them still fall under "fair use" if they don't.

I dont use live well to download the odd demo but what will happen when your 360 needs to e upgraded to play the latest games.What would happen if you bought a second 360 dvd drive on used tht one to play your backups

Apparently it is the console ID that is being banned from live. I imagine you could just burn the update and use it on your console without live in between (there has to be some way to update 360 if you don't have internet... right?)

Good job taking the "i'm superman" road. You're getting banned for sure. NOBODY knows exactly what the hell is going on but it's CONFIRMED that they're banning, this is no server overload. The best bet now is to stay off live, although that's gonna do no good anyway if they already got the machine's serial from the spring update or whatever.

I know many on here won't share my opinion. I believe this is a good thing.

I spend a fortune on my Xbox 360.. 20+ games, 4 pads, HDDVD drive, 42" samsung HDTV.. etc

I spend that money because i believe the enjoyment i get is worth it.. Every friday night me and the lads get the beers in, have a bit of 4 player worms / COD3 / Pro Evo.. It's great fun. I do agree games are quite expensive but the development costs / marketing costs are high aswell.

I don't think this will affect Microsoft at all, infact it will probabley increase sales. People who have modded the 360 will have a couple of options.

1. Buy new 360 and purchase games
2. Don't buy new 360 and buy PS3

For the most part people will already be hooked / enjoying what the 360 has to offer and will have no option but to re-buy. Lets face it, i've owned a PS3 and know that it isn't exactly the hottest thing going right now. Is why i sold it. Apart from Motorstorm and VF5, it's wanktastic.

Finally all you guys are gonna have to do what the rest of us do. Use your hard earned money to purchase your games.

The ban applies only to the console, not the user, so there is nothing stopping a modder from obtaining another, unmodded system and joining in the fun on Live.

Oooh, yes. I didn't think about that. I wouldn't doubt it, I wanted to play Halo 3 Beta but I sure as hell wouldn't spend another 300 bucks on a semi demo. I won't even spend 130 bucks for the Legendary game, so I obviously wouldn't spend that much. Then if it really is your console, they'll have your console on file through live, and they may be able to just unlock it straight from the place. *Shrugs* I've never had a problem with any phone service to the degree of them saying "You're SOL." lol. So I doubt that MS would be any different. Though, for the people who really HAVE had this happen and aren't modded, it is a minor problem but I think it's for the best as well. I try and support the Video game industry so I don't pirate games.

But basicly, I don't see the problem aside from those who weren't modded, the "No modded consoles on Xbox Live" policy has been around since the first Xbox. When I modded my Xbox, I had to make the decision, they are no different. My advice: Don't play live for the next couple days. lol

I feel sorry for anyone who has been banned and has not got a hacked console, and I hope MS sort it out for them. For everyone else who got banned and is bitching about it, what did you expect, it never to happen or somthing? XBL has the free ride for so long made you forget the original Xbox, you had a choice:

1. Don't mod and play originals on live
2. Mod it and be banned from live but still be able to play copies offline
3. Use a mod with an off switch to play originals on live and copies offline.

You can still do number 2, which is what most people with hacked consoles want anyway. XBL access has been a free ride for a while, but it was always inevitable that MS would stop you from using copies on it sooner or later. Just be greatfull you can still get all your games for free still, and can play system link MP.

Also to all those saying this makes the PS3 better, can't you actually see the idiocy in your words. This is more or less what you are saying

lol What are you talking about "scan drives"? I never said microsoft scanned drives. What I said was that when receiving a refurbished console you can guarantee that it will be flashed with the most current firmware and or software at the time of being shipped and set to factory defaults (this includes almost any form of electronic that has upgradable firmware "psp" for example) . Why did I say guarantee? Because its factory standards when refurbing these kind of electronics. We have already gotten into a discussion on another thread about refurbished electronics where you were proven wrong not just by me but other posters. You can believe whatever you choose to believe and if you're naive and uneducated about these topics there really isn't much use of fighting because you will only believe what you think is correct.
