View Full Version : MS hit with new class action lawsuit over Xbox 360 defects
A new lawsuit has hit MS regarding the excessive number of Xbox 360 failures. The lawsuit further alleges that MS concealed the dreaded RRoD in order to compete with its other gaming rivals. The law suit draws on recent revelations that MS knew all about the RRoD and seeks an order that MS disgorges all profits attributed to the Xbox 360 as well as a implement a refund program in California.
Microsoft are facing a lawsuit, brought under California's consumer protection statutes, was filed in the Sacramento County Superior Court. The lawsuit alleges that an excessive number of Xbox 360 consoles have failed, resulting in what is commonly known in the gaming community as the "red ring of death". The lawsuit further alleges that Microsoft concealed the excessive failure rate of its Xbox 360 consoles in order to compete with the pending launch of Sony's Playstation 3 and Nintendo's Wii gaming systems.
The lawsuit cites to a number of recent articles published in gaming trade journals and on popular websites including dailygamesnews.com, VentureBeat, Digital Media and Yahoo! Those articles contend that Microsoft knew as far back as November 2005 that over 50% of the Xbox 360 consoles involved in the initial sales launch were defective.
The class action lawsuit seeks an order that Microsoft disgorge all profits attributable to its sale of the Xbox 360, as well as that Microsoft publicly announce and implement a refund program in California.

the lawsuit will just get dismissed. microsoft already offer a 3 year warranty on the known 3rol defect.

That does not mean anything when they released a defective product and lied about knowing the cause. The 3 year warranty was a band-aid for a shotgun wound. It never fixed the problem, hopefully this lawsuit will!

and after your 3 year warranty is up your 360 is basically doomed, and i am on my fourth now so I am just going to mod it with a better heatsink:)

the problem is this....
My brother has experianced 2 RROD (on 2 diff systems) and eventually decided to buy the new one for $199.99 (which I did discorage against for the sole reason of the cost involved...Its ridiculous.)
But then reading this here online and all the reported issue with close personal experiance.... it must be a real problem.
Thing is PSX the origional had the same problem (life span of 2 years and then it quits)
Hell EB games eventually offered an extended warrenty program of 50 dollars with the purchase of the system for an additional 2 years ofter OEM warr expired giving the consumer the ability to walk in with the dead untit and do an over the counter exchange for a new one.
So this sort of thing happens.
The aligation of this problem being planned.... I have no comment.
Its very possiable that Microsoft was just too concerned about what had happend with the 1st xbox, they decided to to make 360 with nothing but sole preparatory parts to make it more difficult for hackers, the downside is when any company does this, you usually end up with a can of worms and over time the kinks are worked out through new models, etc..
Take a Hybrid care for example.... If your patriotic and have 30 k to throw around you will buy north american. If you want something with the kinks worked out you will go with Honda for ex.
But out of all the possiable companies, you would expect Microsoft to be the least likly for something like this to happen.

Can't say I feel sorry for them. My main concern is that in the future none of the publishers tries to do something like this again. People try to excuse what MS did with sony's past, but I don't care what happened in the past, and if we follow that train of thought this will always keep happening, so the solution is to establish an example of what will happen to a company if they slack off on R&D, Q&A, or whatever the reason for the 360's high failure rate is.
I hope they learn or I will not get the third xbox

I hope they realize that one they release a new xbox, people will still be hauted by this problem and this will affect the sales.

woot... recall,refunds, lifetime warranty or whatever this lawsuit outcome will be im for it. anyway, this should have been filled long time ago seriously. its not like this lawsuit will fail, its just the m$ compensation for the 360 hardware failure to consumer will be low/minimize since M$ can justify that they had addressed this issue and offer 3years of warranty for the consumers who are having this RROD. so theres a lil chance this lawsuit will fail or be taken to minimal compensation.

im a bit freaked out right now, a rep told me that the warranty is 3 years extended from the time you send the first 360 which i did not understand at first but if that is right then that means that from the date you first sent in a repair for RROD your 360 in 3 years your warranty for any 360 you have even if you sent it back 10 times is gone, and that means you are doomed
