View Full Version : Sony facing another PS3 suit over CELL CPU
Sony has already been hit with a double whammy of law suits over Blu-ray and the PS3's digigtal security technology and now it looks as if its bracing itself for a third. Parrallel Processing Corporation are taking Sony to court of the CELL chip claiming they have some patent dating back to 1991 of which the CELL infringes upon.
In its suit, Parallel Processing Corporation of Newport Beach, California, cites a patent for "synchronized parallel processing with shared memory" that was approved on October 8, 1991. The patent was originally assigned to International Parallel Machines of New Bedford, Massachusetts, while Parallel Processing Corporation describes itself as its "exclusive licensee."
The terse five-page complaint--filed in the Eastern District of Texas (Tyler Division)on July 26--claims that Sony products including the PS3 infringe upon its patent. The suit doesn't specify which of the patent's claims Sony is infringing upon, but it states that the company's actions "are causing irreparable harm and monetary damage" to the company. Parallel Processing Corporation is seeking damages and attorney's fees with interest, as well as the impounding and destruction of all Sony products that infringe on the patent.

It's getting ridiculous. Probably be hit soon with a copyright infringement over the colour of the console. Or the shape of it, like the PS2 did. haha.

Its more than likely one of the usual run of the mill patent trolls that all electronics firms have to fight off. No one with any success is immune to it. Lucent sued Microsoft over their Mpeg-2 decoding method, Lonestar innovations has sued Nintendo over the Wii's main board. Nothing new...im sure there will be more. Sometimes they settle just to get rid of them, sometimes they dont....

Besides the fact that this whole lawsuit is just a whole bunch of bullsh1t, why the heck are they suing Sony for the cell processor, It's not like Sony created it or anything. As far as I am concerned they should be suing IBM for this so called "patent infringement". This is getting very ridiculous, here we have a unknown company that sucks ass, which is trying to get noticed by suing a company who did not even create the damn thing...... oh yea your cool. It's always loser companies who try to feed off of the success of other popular/big companies like SONY.
OK so they patented something that they never got around to using...... sometimes I just want to smack stupid deushes, just for being stupid.

Cell is a microprocessor architecture jointly developed by a Sony, Toshiba, and IBM, an alliance known as "STI."
During this period, IBM filed many patents pertaining to the Cell architecture, manufacturing process, and software environment.
Cell servers are really not widespread yet, sony made the first commercial use of the technology in question therefore they have gained from the technology/patent.. no matter if IBM is the main patent filer.
The patent is firmly established and much like the blackberry saga just because the company hasn't created the hardware surrounding the patent doesn't mean it's less valid.. will it pay off? probably in a side settlement

They can but they would never get it. If Sony is using the patent they will end up having to license it and will pay a large fee then a few dollars for each future console.
These kinds of lawsuits almost always contain something like this. If I remember right the rumble lawsuit was asking for Sony to be forced to halt all sales of the PS2 and any games that used rumble. Except for the removal of the rumble feature from the PS3 the average consumer never knew or cared about the lawsuit.

Shouldn't there be some kind of punishment for not utilizing your patents for more then 10 years? It amazes me that the courts entertain these lazy a$$ bums. You want money? WORK YOU BIOTCHES!
I'm really looking forward to the day when a judge bust out laughing at one of these things and makes whoever files the lawsuit go to jail for "waisting the court's time" or something like that.

There should be a law against filing patents and then purposely sitting on your ass until someone develops something similar because their thought process was similar and then suing them for infringement. Companies should be required to be investing significantly in their patents on a regular basis in order to keep them. That would prevent patent whores from trying to make money off of someone else's work.

Intel CPU doesnt share their memory, thats not in patent details.

I blame as I have said before the patent office monkeys who have not flagged this as a possible problem as its clear that the 3 companies involved in the cell's creation filed patents around it.

Because attempting to sue IBM is akin to taking on the Nazgūl with nothing more than a toothpick. IBM owns more patents than God, and their legal team is appropriately nicknamed the "Nazgūl". Odds are likely that this company is infringing on several IBM patents, and they would probably like to avoid drawing the Nazgūl's attention. Plus with Sony having been weakened, so to say, in the console market, this company probably smells blood, and decided to attack.
