can NXE and HDD rip prevent bannings?

with people getting banned for games on live and the fact people say its safe to play backups offline and nxe can use burnt games to validate loading
can nxe prevent bannings?
if the game is checked offline and after that is loaded from HD no chance of banning right?

think that ms will be smart enough to log the dumping process and also the dvd has to be in the tray anyway, security checks. > logs.
i think that it doen'st matter, it's a given fact that they will hammer you, just a matter of when it happens.
